05 October 2023

Last year, the government ran a range of consultations on some specific proposals for how the in-occupation phase of the higher-risk regime would work. The government recently published its response to the consultations, which includes changes it intends to make following feedback on its original proposals, and where it acknowledges concerns raised about particular proposals.

We’ve summarised the government’s response, its current policy position, and any changes to its original proposals. This briefing includes information on:

  • Building Assessment Certificates.
  • Principles for managing building safety risk and the building safety case report.
  • Mandatory occurrence reporting.
  • The residents’ engagement strategy, complaints, contravention notices, and providing residents with safety information.
  • What the principal accountable person or relevant accountable person will provide to residents, requests for further information, and storing information on complaints and contravention notices.
  • How the golden thread is stored and managed.
  • The contents of the golden thread.
  • The enforcement of compliance notices.
  • Reviews and appeals in response to a decision made by the Building Safety Regulator.
  • Duties on accountable persons to share information with each other, the Building Safety Regulator, Responsible Persons and the client.
